Come and learn how to navigate contentious trade mark proceedings at the Intellectual Property Office of Singapore (IPOS). This workshop is practical, hands on and provides insights behind the practices and procedures for trade mark oppositions, invalidations, revocations and appeals. Participants will learn the ins and outs of contentious proceedings at IPOS. Importantly, you will be acquainted with our most recent Practice Circulars as well as handy tips when using the new IP²SG platform. Participants will be introduced to the mediation option for trademarks disputes, provided to parties under a collaboration between IPOS and the World Intellectual Property Organization (WIPO). You will obtain a holistic view of the different facets of such contentious proceedings. Assistant Registrars from the High Court, managing the IP list, will address issues relating to appeals from IPOS. In another first, a District Judge from the State Courts Centre for Dispute Resolution will train participants in the art of mediation advocacy. Learn how to make the most of IP mediation through an interactive role play session.

Trademarks, copyrights, patents, registered designs, geographical indications and other IP rights are often approached as a series of distinct rights. In reality, however, these IP rights often overlap in a single product or service. This seminar propounds the rationale for viewing IP from the vantage of overlapping rights, and explores a possible rubric that can be applied in considering any IP overlap. Several important Singapore cases involving overlapping IP rights will be discussed. In view of upcoming changes to Singapore's laws on geographical indications, the overlap between trade marks and geographical indications will be discussed in a separate session.

From the lawyer's perspective, what are the differences in experience and outcomes between mediation and IPOS adjudication? From the mediator's perspective, what is needed to achieve win-win? Copyright and trade mark laws in Singapore provide for both civil and criminal remedies against infringers. Criminal enforcement measures are particularly useful weapons against counterfeiting.

However, there is a dearth of information on criminal IP enforcement, particularly in relation to practical and procedural aspects. We have assembled a distinguished slate of speakers to share with participants their expertise and experience in a broad range of areas. Participants will first be treated to an overview of IP enforcement in Asia, with a focus on ASEAN. Thereafter, the speakers will delve into both the legal and procedural aspects of criminal enforcement in Singapore, including a discussion of investigative techniques encompassing computer forensics.

Charles F. Kettering (an American engineer, the inventor of the electric starter and holder of 140 patents) had said “Thinking is one thing no one has ever been able to tax.” 

Well … that’s not exactly true.

IP being the output of innovation can generate financial gains, and as such it is an asset taxable upon transfer. However, given the largely intangible and often cross-border nature of IP, IP transactions can raise complex tax issues on which specialist advice should be sought. For MNCs, mastering strategies for planning IP assets are critical for tax avoidance; for policy makers, keeping abreast of these strategies are critical for combating Base Erosion & Profit Shifting (BEPS).

This seminar will provide an overview of the relationship between tax and IP and highlight the various tax considerations and challenges affecting IP in today’s world. Patent filings are on the rise worldwide, reflecting the development of technology in the global economy. As a result, the stakes in patent disputes are rising, but inefficient dispute resolution procedures and inconsistency of outcomes across jurisdictions can cast a shadow on the marketplace.

As one of the tools available to reduce these risks, expert determination allows disputing parties to submit a specific matter (e.g. ​a technical issue) to a subject matter expert of their choice to make a determination. Generally confidential and binding, expert determination may assist the parties in resolving the entire patent dispute (including valuation of intellectual property rights or the establishment of royalty rates), since the key areas of the dispute are usually technical in nature.
